Course Booking Terms and Conditions – WA Barista Training Lab

These Terms and Conditions ("Terms") govern the barista training services offered by WA Barista Training Lab (referred to as "The Centre" or "we" herein). Located in O’Connor, Western Australia, we are a reputable barista training centre dedicated to providing comprehensive and professional barista training programs to Participants (referred to as "The Participant" or "you" herein).

By enrolling in and participating in any of our barista training courses or programs, you acknowledge and agree to abide by these terms and conditions, which govern the relationship between The Centre and The Participants during the training process.

It is essential that you carefully review and fully understand these terms and conditions before proceeding with the enrolment process. Your acceptance of these terms is fundamental to your participation in our training courses.

As we prioritise the quality of your learning experience, we have crafted these terms and conditions to ensure clarity, fairness, and respect for all parties involved. 1. Enrolment and Payment
1.1 Booking Process: To secure your spot in a barista training class, you must make a booking through our official website at www.wabaristatraininglab.com.au. Bookings are subject to availability, and we reserves the right to refuse any booking at its discretion.
1.2 Participant Information: During the booking process, you must provide accurate and up-to-date information about yourself and any other Participants, including contact details and any other necessary information required by The Centre.
1.3 Class Attendance: By registering for a class, you commit to attending the specified date and time of the session.
1.4 Payment: Payment for the selected training course must be made in full at the time of booking.
1.5 Discounts: Promotional discount codes may only be redeemed at the time of booking.

2. Participant Requirements
2.1 Age Requirement: Participants must be at least 15 years old to enrol in the barista training courses at The Centre, unless accompanied by an adult. The accompanying adult will also need to make a booking and pay full price for the course.
2.2 Footwear: It is a mandatory requirement that Participants wear closed-in shoes during the class to comply with occupational health and safety regulations. Sandals, open-toed, or other non-enclosed footwear will not be permitted for participation.
2.3 Accommodation Requests: Participants who require specific accommodations are encouraged to contact The Centre in advance by emailing mail@wabaristatraininglab.com.au to discuss their needs. We are committed to making reasonable adjustments to support their participation in the training.
2.4 Assistance of a Carer: If The Participant requires the assistance of a carer during the training, approval from The Centre must be obtained before enrolment by emailing mail@wabaristatraininglab.com.au. The carer can attend free of charge and they must be present throughout the training to provide necessary support.
2.5 Feedback: Participants are encouraged to provide feedback on any barriers or challenges faced during the training. All feedback will be treated with utmost confidentiality and will be used to improve the learning experience for future Participants. Please direct feedback to mail@wabaristatraininglab.com.au.

3. Course Schedule and Certificate
3.1 Course Schedule: Upon booking, Participants receive a confirmation email with class details. This email includes links to reschedule or cancel your booking. Before the class, a follow-up email will provide essential information, location, and requirements.
3.2 Certificate of Completion: Upon successful completion of the training course, Participants will be given a Certificate of Completion by The Centre.

4. Rescheduling Policy
4.1 Rescheduling Window: Participants may reschedule bookings up to 48 hours before the scheduled class start time.
4.2 Rescheduling Procedure: All rescheduling requests must be made online through the link received in the booking confirmation email. The Centre may not accept rescheduling requests made through any other means.
4.3 Availability: Rescheduling is subject to availability in the desired class date and time. The Centre will make reasonable efforts to accommodate rescheduling requests but does not guarantee availability.
4.4 Out of Notice Terms: If you fail to provide the required 48 hours' notice for rescheduling, you are not permitted to reschedule the class. If you do not attend the class, you will forfeit your payment.
4.5 Company Discretion: The Centre reserves the right to make exceptions to the Rescheduling policy on a case-by-case basis in its sole discretion. Such exceptions shall not constitute a waiver of these Terms and shall not create any obligation for The Centre to grant similar exceptions in the future.

5. Cancellation Policy
5.1 Cancellation Window: Participants may cancel bookings up to 48 hours before the scheduled class start time.
5.2 Cancellation Procedure: All cancellation requests must be submitted online through the link received in the booking confirmation email. Cancellation requests made through other channels will not be accepted.
5.3 Refunds: Participants will receive a refund if they cancel their booking at least 48 hours before the scheduled class start time. The cancellation must be made through the link provided in your booking confirmation and the refund will be automatically processed.
5.4 Cancellation by Centre: The Centre reserves the right to cancel or reschedule a course or training program due to unforeseen circumstances, low enrolment, or any other reason. In such cases, Participants will be offered an alternative course date or a full refund. In the event of course cancellation, The Centre will provide Participants with as much notice as possible using the contact details provided during enrolment.
5.5 Cancellation Due to Illness: If a Participant falls sick and cannot attend the barista training class, they must notify The Centre as soon as possible. With appropriate documentation, like a medical certificate, they may be eligible to reschedule the class. The final decision on rescheduling will be at the discretion of The Centre. 5.6 Company Discretion: The Centre reserves the right to make exceptions to the cancellation policy on a case-by-case basis in its sole discretion. Such exceptions shall not constitute a waiver of these Terms and shall not create any obligation for The Centre to grant similar exceptions in the future.

6. Enrolment Transfer Policy
6.1 Transfer Request:
You may transfer your course enrolment to another person ("the Replacement") if you can't attend the course. The Replacement must meet course prerequisites, subject to The Centre’s approval, and comply with course rules.
6.2 Transfer Request Procedure: To request the transfer, notify The Centre in writing at mail@wabaristatraininglab.com.au before the course start date, providing the Replacement's full name and contact information including email address and contact number.
6.3 Confirmation and Approval: The Provider will confirm and approve the transfer. Upon approval, you'll receive written acknowledgment.
6.4 Transfer Availability and Limitations: The transfer to the Replacement is free of charge for both you and the Replacement. Course enrolment transfer availability may vary and is limited to a one-time use per Participant. The Centre reserves the right to refuse any transfer request at its discretion. If you choose not to proceed with the transfer, standard cancellation and refund policy apply.
6.5 Company Discretion: The Centre reserves the right to make exceptions to the Enrolment Transfer policy on a case-by-case basis in its sole discretion. Such exceptions shall not constitute a waiver of these Terms and shall not create any obligation for The Centre to grant similar exceptions in the future.

7. No-Show and Late Arrival Policy
7.1 No-Show: Participants who fail to attend the training course without prior notice ("no-show"), will forfeit enrolment, and no refund will be provided.
7.2 Late Arrival: Participants who arrive more than 20 minutes after the scheduled start time may not be allowed to join the class and may be considered as a no-show.

8. Code of Conduct
8.1 Respectful Behaviour: All Participants are expected to conduct themselves in a respectful and professional manner during the class. Disruptive, disrespectful, or inappropriate behaviour towards Instructors or other Participants will not be tolerated.
8.2 Non-Discrimination: Discrimination, harassment, or any form of prejudice based on race, gender, religion, or any other protected characteristic will not be tolerated.
8.3 Prohibited Activities: Participants shall not engage in any illegal or unsafe activities during the class or on the premises of The Centre. Engaging in any form of disruptive, offensive, or harmful behaviour is strictly prohibited.
8.4 Compliance with Instructions: Participants must follow all instructions provided by the Instructors for their safety and the safety of others.
8.5 Health and Safety: Participants must adhere to all health and safety guidelines and protocols provided by the Instructors to maintain a safe learning environment for everyone.
8.6 Confidentiality: Participants must respect the confidentiality of any sensitive information shared during the training program.

9. Intellectual Property Rights
9.1 Course Materials Ownership: All course materials, including but not limited to training manuals, presentations, videos, and any other resources provided during the barista training, are the exclusive intellectual property of The Centre and its Instructors.
9.2 Usage Restrictions: Usage Restriction: Participants in the barista training program at The Centre are strictly prohibited from taking photos or recording videos of the presentation slides used during the training sessions. Participants enrolled in the barista training programs shall not reproduce, distribute, modify, or publicly display any course materials. All course materials, including presentation slides, are protected under intellectual property rights and are exclusive property of The Centre.
9.3 Personal Use Only: Participants are granted a non-exclusive, non-transferable license to use the course materials solely for personal learning purposes during the training period.
9.4 No Commercial Use: The course materials may not be used for commercial purposes, such as reselling, sharing with third parties, or incorporating into other training programs.
9.5 Intellectual Property Violations: Any unauthorised use or distribution of The Centre’s intellectual property may lead to legal action and be subject to civil and criminal penalties.

10. Marketing and Promotion
10.1 Photographs & Video:
Photographs and short videos may be taken during the program for promotional purposes on social media.
10.2 Opt-Out Option: If you prefer not to have your images or testimonials used for marketing, inform the Instructor at the start of the class. Your materials will not be used in future marketing efforts. While The Centre will make reasonable efforts to obtain consent before using Participants' images or testimonials for marketing, it is not responsible for unauthorised use by individuals beyond its control.
10.3 Non-Commercial Use: Your images and testimonials will only be used for promoting The Centre’s services and activities. They will not be sold or shared with third parties for commercial purposes.
10.4 Revoking Consent: You can revoke your consent for marketing use at any time by contacting The Centre in writing at mail@wabaristatraininglab.com.au. Your materials will be removed from future marketing efforts.

11. Injury Liability
11.1 Assumption of Risk: Participants understand and acknowledge that the use of barista equipment involves inherent risks. They voluntarily assume all risks associated with operating the equipment during the training.
11.2 Injury Notification: In the event of an injury or accident during the class, Participants must immediately notify the Instructor.
11.3 First Aid and Medical Attention: The Centre will provide necessary first aid assistance for minor injuries. 
11.4 Medical Expenses: Participants are responsible for any medical expenses resulting from injuries sustained during the class.
11.5 Report and Documentation: All injuries, accidents, or incidents occurring during the class will be documented by The Centre for record-keeping purposes.

12. Liability and Indemnity
12.1 Liability: The Centre shall not be liable for any loss, injury, or damage to personal property or belongings during the training course.
12.2 Indemnity: Participants agree to indemnify and hold The Centre and its Instructors harmless from any claims, losses, or damages arising from their participation in the training course.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Australia. Any dispute arising out of or relating to these Terms or the barista training courses shall be exclusively subject to the jurisdiction of the courts of Western Australia.
